SALYERSVILLE, Kentucky — An eastern Kentucky judge has rejected a plea deal and sentenced an eastern Kentucky man to five years in prison in the death of his son.

WYMT-TV (http://bit.ly/15SQeFz) reports the sentenced was handed down on Thursday to James Garcia in the death of 4-year-old Cameron Mullins. A coroner's report said the boy died of blunt force trauma.

Garcia was originally charged with manslaughter, but entered a plea to reckless homicide in which prosecutors recommended a 16-month sentence.

The judge decided not to take the recommendation, saying Garcia hasn't shown any remorse. She sentenced Garcia to the maximum under sentencing guidelines for the crime.

Scottsbluff Police arrested a Scottsbluff man Tuesday on charges of abusing his 6-year-old boy after the boy denied taking a key.

Joseph Hafner, 40, has been charged with committing child abuse with intent, a Class IIIA felony. He was arraigned on charges Wednesday in Scotts Bluff County Court and is scheduled for a preliminary hearing on May 21.

Scottsbluff Police arrested Hafner on Tuesday after receiving a report that Hafner’s 6-year-old son had told staff at his school that his dad had smashed his face to the ground and spanked his lower back. In a forensic interview at CAPstone, the boy told police he had suffered a bloody nose after his dad slammed him to the ground in the family’s kitchen.

The boy had several contusions and red marks on his back and bruising, including bruising on his upper left shoulder and a bruise on his right forearm. A Regional West Medical Center emergency physician told police the boy appeared to have also suffered injuries on his right arm that were consistent with being grabbed.

Police contacted Hafner at his wife’s business. When he told Hafner why he wanted to speak with him, Hafner allegedly admitted the abuse, telling police “that he ‘did it’ and he should arrest him now.” Hafner complied with a request to come to the police department for questioning. During questioning, he told police he had been under a tremendous amount of stress and had been home with his son and four other children after the funeral of the couple’s stillborn child. He had been looking for a key to a garage and had questioned the children. The boy had denied taking the key, but Hafner said “lost it,” the affidavit says, and he picked the child up and threw him onto the kitchen floor. During the throw, the child struck his nose and mouth. Hafner also told police he had struck the child on the small of his back before realizing he was out of control and going into the basement of the home.

Hafner is being held on a $75,000 bond.

Father accused in his baby's abuse death defends actions from jail

SACRAMENTO, CA - Three weeks ago, Alias McLaughlin was a new father. Now, he's a suspect in his baby's death.

"I was actually accused of murdering my own little girl and now, well, here I am," McLaughlin said from Sacramento County Jail.

Sacramento police believe McLaughlin violently shook and threw his newborn daughter last Friday after the baby woke up crying. In a jailhouse interview, McLaughlin said he never hurt his daughter, but was trying to stop her from choking on milk.

"We [the child's mother and McLaughlin] specifically saw her aspirate with milk in her throat," said McLaughlin. "But they're telling us there was no milk or fluid in her lungs."

At one point, McLaughlin said his daughter started gasping for air.

"I didn't know what to do. I was going out of my head. I was freaking out. So I went outside to have a cigarette and talked to my girlfriend, and she said we should call 911."

McLaughlin said he didn't want to wait for paramedics, so he performed CPR on his daughter three times. When the little girl finally arrived at UC Davis Medical Center, she wasn't breathing and appeared to have injuries. Doctors called police.

The coroner's report says the baby died of blunt force trauma to her head.

McLaughlin's girlfriend also told police it was McLaughlin who shook their child and threw her down on the ground. When she tried to protect their daughter, she claimed McLaughlin attacked her.

From jail, McLaughlin said he never hurt his child, but does admit to shoving his girlfriend.

"I was going like that, grabbing her and pushing her, 'Why were you not giving her the bottle?'" McLaughlin said he yelled at his girlfriend while the baby was crying.

McLaughlin says he attended anger management classes in the past.

News10 efforts to reach the baby's mother at the home the couple shared were unsuccessful.

McLaughlin faces murder charges for his daughter's death, but says he doesn't understand what happened that night or what he could have done differently.

"I didn't mean to do anything. I just wanted to take care of her," he said. "That's all. That's all I wanted to do was take care of my daughter."

McLaughlin wears a padded suit for his own protection and has seen a psychiatrist while in jail, according to officials.

Father accused of murdering 6-week-old son

A father is behind bars for allegedly killing a 6-week-old baby. Sources tell KHON2 the baby was his own son.

Paramedics were called to the Mokuola Vista apartment building in Waipahu at about 3:30 p.m. Tuesday.

They found 6-week-old Gabriel Membrere unconscious. He was taken to a nearby hospital, where he was later pronounced dead.

The Medical Examiner’s office is releasing little information about the extent of the baby’s injuries, but say he suffered trauma to his head.

A next door neighbor — who did not want to be identified — said she heard yelling coming from the apartment.

“I just threw the trash bag and was walking over here and I didn’t want him to see me,” the neighbor said. “He kept shouting and shouting and saying a bad word. I thought he was drunk.”

The baby’s father, identified as 38-year-old Joel Asuncion, is now being held for murder in the second degree. He turned himself in to Honolulu Police Wednesday night.

Asuncion has a criminal history including felony charges for burglary and theft, and misdemeanor charges for family abuse.

The Department of Human Services offered condolences to the family and said deaths like this are a reminder “…that the entire community needs to be vigilant and report suspected abuse…”

They say for confidentiality purposes, they are unable to confirm if Asuncion has other kids or if anyone from the Asuncion-Membrere family had been previously investigated by Child Protective Services.

“That is sad. If you can’t take care of your child then you shouldn’t be having a child,” neighbor Connie McKeague said. “To have a child is a blessing.”

Police and the Medical Examiner’s office are continuing their investigation into the murder of the baby boy.
