Fayette County Sheriff Steve Kessler says the man’s body was found Wednesday in Thurmond.

Madill father gets 4 years in infant son's death

MADILL, OK -- A Madill father accused of killing his own son in July, pleads guilty.

Court records show Joshua Irvine had been charged with second degree murder, but pleaded guilty to second degree manslaughter.

Madill Police said Irvine was alone with his four-month-old son and two other children when the baby became unresponsive. The infant later died.

Court records show Irvine was sentenced to four years in prison.

Another mom loses custody of kids to child sex offender father

-- Many News 4 viewers were shocked to learn Tuesday that sex offenders can have custody of children under Missouri Law.

After a News 4 investigation, lawmakers tell us they’ll look to close a potentially dangerous legal loophole.

But sadly, one mom told News 4 it’s too little, too late for her little girl.

The mom says her ex was given joint custody of her kids, even though he’d been convicted of inappropriately touching a child.

Missouri laws do prohibit some kinds of sex offenders from having custody of their kids, but not all sex offenders, not even ones who harmed children.

The laws are written to give judges a lot of discretion, but some say they must be changed to make sure all kids are safe.

“It needs to get changed, before more children are hurt,” said Mullens.

Ashley Mullen herself was just 16 when she married Ryan Simpson. At the time, she didn’t know he is a registered sex offender, convicted of inappropriately touching a 10-year-old girl.

When they divorced, Mullen thought surely he wouldn’t get custody of their two kids. But she was wrong.

“The judge had granted 50/50 custody,” she said.

Because Simpson was charged with only a misdemeanor, sexual misconduct, under Missouri law, he’s not specifically excluded from custody, even though his victim was a child.

Mullen had no choice but to give her kids to their dad every other week, until she noticed something terrifying.

“They were playing weird, the ways children don’t play,” Mullen said.

Simpson wasn’t charged, but a new judge took his custody rights away. Still, Mullen worries it was too, late.

“Do you feel like the system failed to protect your two kids?” asked News 4 Reporter Lauren Trager. “Oh yeah, it did, it did, the system failed to protect my children.”

The judge in Jefferson County was unavailable Wednesday.

Lawmakers we talked to said judges must be scrutinized, but they also said the laws needs to be re-evaluated.

But it won’t happen this session and Mullen wonders whose child might be harmed in the meantime.

LEE’S SUMMIT, Mo. – Punishing an infant for crying and sucking its thumb has a Lee’s Summit man behind bars.

Twenty-year-old Nathaniel Bearden is charged with one count of felony child abuse. Documents released by the Jackson County Prosecutor say Bearden does not allow thumb sucking or much crying — and that’s why he repeatedly hit his baby.

The injuries sent the baby to the hospital.

“It’s very important for parents to understand is crying is a normal part of child development and thumb sucking is a natural reflex that children have to self soothe themselves,” said Monica Enloe, Development Manager for Kansas Children’s Service League. “I mean, they start doing it when they are in the womb and it’s a very normal part of childhood.”

The baby boy, named in court documents by his initials “KB,” was struck in the face at least five times by his father, Nathaniel Bearden, documents showed.

Bearden told police he hit the boy because he was sucking his thumb.

“It’s a normal part of children growing up,” Enloe said. “There is a lot of brain development happening when children are that young. Ninety percent of a child’s brain is developed before the age of 5.”

Police were called to the home by the child’s mother who noticed blood in the baby’s eyes and confronted Bearden, court documents say.

In a statement to police, Bearden admitted the abuse.

“We know that hitting or striking a baby can cause blood shot eyes,” Enloe said. “Also shaking or choking can cause that as well.”

Kansas Children’s service League acknowledge the difficulties of parenting but say hitting, choking, shaking are never okay and have joined the purple hat campaign to remind parents that crying is part of a baby’s growth.

“We give parents the purple hats to remind them that it is normal, they are not doing anything wrong,” said Enloe. “And even though its incredibly frustrating it’s important to continue to care for your child and recognize when you are frustrated and to put them in safe place and to walk away for a minute.”

Bearden pleaded not guilty at his arraignment hearing on Tuesday. He remains in jail on a $75,000 cash-only bond.
