Dad admits shaking two-month-old baby

A Melbourne father has admitted injuring his two-month-old baby by shaking him, in a case a magistrate says is too serious for her to decide.

The man was 18 years old when he shook his baby son on three separate occasions in 2011.

One of the shaking episodes left the child requiring emergency surgery.

Both the prosecution and the father's lawyer urged Magistrate Amanda Chambers to decide the matter, saying she could hear it because the appropriate penalty was the 31 days he had already served, and a community corrections order.

But Ms Chambers refused, saying the matter was serious and should be heard by a Victorian County Court judge.

"In my view, the overwhelming seriousness of the offence makes it inappropriate (for the) matter to be heard in this court," she said.

"Parents, even those very young, have a core parental obligation – that is to do no harm to their children."

Ms Chambers said in her time on the bench, she had never decided a baby-shaking case.

A summary of the offence was not read out, but the court heard some details, including that the father shook the baby three times in August and September 2011.

In September 2011, the father injured the baby when he shook him, the court heard.

The baby required surgery. While he appears fine so far, the extent of the damage will not be known until he is older and it can be seen if he achieves developmental milestones, prosecutor Peter Rose, SC, told the court.

The father pleaded guilty to negligently causing serious injury, and to two counts of reckless conduct endangering serious injury.

His lawyer Peta Murphy said it was always a serious matter when a baby was involved.

She said when the father shook the baby, he was a struggling young parent who did not intend to harm the child.

Ms Murphy said the father had been referred to a psychologist to examine if he had an acquired brain injury.

Ms Chambers continued the father's bail and ordered him to face a pre-sentence hearing in the County Court on April 26.

An Indianapolis father was arrested after, police said, he left his 3-year-old son unattended inside his pickup truck while he was in a nearby trailer smoking marijuana.

Police were called at about 8:30 a.m. Wednesday to the Garden City Mobile Home Park in the 4900 block of Rockville Road on a report of an unattended child. The caller told police that the toddler had been in the truck for about 30 minutes and the vehicle’s engine was off, according to an Indianapolis Metropolitan Police Department report.

Officer Jason Thomas did not see anyone in the area but heard loud conversation coming from a trailer nearby. There, he talked to Ronald Albrecht, 33, who later said he’s the boy’s father, Thomas wrote in his report. Three other people where inside the trailer.

Albrecht said his son had only been in the pickup truck for 5 minutes. He later changed the time to 10 minutes, and altered it again, saying the toddler may have been there for 15 minutes. He also said he left his son there because he didn’t want the boy to be in the trailer while he smoked pot, Thomas wrote in his report.

The child was alert and conscious when police went to check on him. He was cool to the touch, his feet were bare, his overall appearance was unkempt, and he did not have a blanket to cover him, Thomas wrote. Temperature that morning was 28 degrees.

Police and medics later found that the child was autistic and was unable to communicate. He was taken to Riley Hospital of Children, where hospital staff found that the boy’s diaper was full, and he had not eaten anything that day, the report said.

Albrecht has been preliminarily charged with neglect of a dependent. He's being held on a $1,000 cash bond at Marion County Jail, according to the county jail log.

A Child Protective Services case worker conducted an investigation and met with the child’s mother at Riley.

Wadeema's father gets death sentence

DUBAI: A father who fatally tortured his daughter was unanimously sentenced to death by the Dubai Criminal Court on Wednesday. His girlfriend was sentenced to life in jail.

Both Hamad, 29, and his girlfriend Al Onoud, 27, were convicted for illegal confinement and gross torture of Wadeema, 8, leading to her death and subjecting her sister Meera, 7, to physical and emotional abuse.

They had locked up the girls in the toilet and forced them to consume their own waste.

Wadeema succumbed to her injuries after being burnt with an iron, cigarettes and having hot water poured on her shaved head. She was also given shocks with electric rods and whipped with cables.

Meera was left with a 10 per cent permanent deformity related to a fracture in her right upper arm among other injuries.

The court acquitted them of concealing Wadeema's corpse because it is natural for offenders in such cases to hide the dead victims without seeking anyone's advice. It is the last chapter in such cases, according to the 44-page ruling.

The duo's defence had vehemently argued that a parent should not be executed for the death of his child. However the court referred to the Maliki School of Law insisting that a parent deserves the death sentence should there be an intention.

"In this case, there was a probabilistic intention as the duo should have realised that the excessive torture could consequently lead to death," the ruling read. Al Onoud had admitted to the torture.

A Guatemalan man who prosecutors say impregnated his 12-year-old daughter five years ago and fled the country when Redwood City police contacted by abortion providers asked him for a DNA sample pleaded not guilty yesterday to several felonies.

The 39-year-old man, who the Daily Journal is not naming as not to identify his daughter, is charged with several counts each of lewd acts on a child under 14 and incest. He will stand trial May 28.

Police interviewed him about his daughter's pregnancy in December 2007 after he brought the girl to San Mateo Medical Center for an abortion. Hospital staff contacted authorities who were told by both him and the girl that a fellow 12-year-old named "Giovanni" was the father. When police asked for a genetic sample to test, the father said he wanted time to consider the request and the next day fled back to Guatemala, according to prosecutors.

The girl later told police her father had impregnated her and she had made up the story of the boy to protect him and not upset her mother. Redwood City police ultimately found the father in Guatemala and had him deported back in late 2012.

He remains in custody on $1 million bail. He returns to court May 7 for a pretrial conference.

HOUSTON - A Houston police officer Wednesday shot and killed a man who was threatening to hurt his son with a large butcher knife, according to authorities.

Police said the father was trying to light what appeared to be a crack pipe at the time.

It happened at the Woodchase apartment complex on South Gessner near Westheimer about 6 p.m. Police said neighbors dialed 911 when they heard a woman screaming inside an apartment.

A man and woman were arguing in the apartment when officers arrived, police said. After police entered the unit, the woman dropped a 1-year-old boy and ran outside, according to investigators.

Police said that's when the father picked up his son and threatened to stab the child with a large butcher knife. Officers said they spent several minutes trying to coax the man into releasing his son, at which time they could see him trying to light a crack pipe.

The SWAT team was called to the crime scene. As officers awaited the arrival of hostage negotiators, the man retreated to a bathroom and tried to close the door, police said.

"They can see him at that point put the knife to the baby's throat and that's when the officers weren't taking any chances on that baby's life and decided to discharge their weapons. One officer discharged a weapon," said HPD spokesman John Cannon. "Suspect was dead at the scene."

Authorities said the child was not hurt. The baby's mother was seen tending to her son while answering questions from homicide detectives.

Police said it is still unclear what relationship the child's father had with the woman he was seen arguing with when officers arrived.

The man's identity has not yet been released. Police said the officer who fired the shot is J. Fisher, a 10-year veteran of the force assigned to the Midwest Patrol Division.
