The state’s highest court reviewed “new evidence” that the condemned prisoner recently submitted, but declared it inadequate to exonerate him of the crime he was convicted and insufficient to establish grounds for a retrial.

Monday’s decision left the doomed inmate with no other option then but to file a last-minute appeal for a stay of execution with the U.S. Supreme Court -- submitted by his defense attorney yesterday.

Otherwise, Richard Glossip is scheduled to be put to death by lethal injection today, September 30th, for allegedly ordering the beating death of his boss, Barry Van Treese, in 1997.

He was twice tried and convicted for that capital murder charge on the sworn statements of a drifter who also worked for the slain hotel operator.

Codefendant Justin Sneed ‘confessed’ to being Glossip’s hitman, aiding the prosecution as its key witness in order to avoid his own death sentence.

Sneed has recanted his testimony many times while incarcerated though, allegedly even bragging that he helped send an innocent man to death row.
