A lawyer for an accused serial baby killer and animal abuser is seeking dismissal of her criminal charges or, alternately, to suppress the evidence against her.
His client, 31-year-old Erika Murray is to be tried for the murder of at least three infants and the deaths of several animals -- the skeletons and carcasses of which were all discovered at her filthy Blackstone, Massachusetts home last autumn.
The defendant has pled not guilty on all counts, and now her lawyer wants the court to provide funding for a forensics expert to analyze those human and animal remains.
He claims Murray is not responsible for the mistreatment, neglect, and killing of either her children or her pets, shifting the focus instead on live-in boyfriend, 37-year-old Ray Rivera, who is also the biological father of the dead children.
Rivera himself has been indicted in the matter and faces a host of charges related to assault, endangering minors, animal cruelty, and drug possession.
Last September police entered the couple’s home near Worcester and found appalling conditions there, including skeletal remains of human babies, fetuses and domestic animals, as well as vermin and feces.
The house was ultimately razed after a team of hazmat-suited workers spent almost a week cleaning and disinfecting the contaminated site.
It’s unclear if Erika Murray’s lawyer truly believes she should be freed now or is merely posturing; and he also refused to elaborate on what evidence he wants quashed, citing the overwhelming public outrage that the shocking case has generated.
The court-appointed defense attorney has until the end of October 2015 to file his motion to dismiss.
